1. Acceptance of Terms & Corporate Entity
These Terms of Service (“Terms”) constitute a legally binding agreement between you (whether an individual property owner, authorized representative, commercial tenant, property manager, or corporate officer) and PureClean Restoration Service, Inc., a corporation organized under the laws of the State of Florida.
By accessing our digital website (https://www.purecleanrestore.com), engaging our 24/7 telephone dispatch hotline, executing an Emergency Work Authorization (EWA), signing an Assignment of Benefits (AOB), or permitting our certified technicians onto your premises, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety.
Oral or digital requests for immediate on-site response constitute authorization for initial psychrometric evaluation, damage containment, and stabilization mobilization under Florida emergency contracting doctrines.
2. Scope of Emergency Restoration Services
PureClean delivers professional emergency mitigation, structural drying, and hazardous environmental remediation services. The scope of work is documented through formal scopes, psychrometric moisture logs, thermal imaging captures, and standard Xactimate® line-item estimations. Services include, but are not limited to:
- Emergency Water Extraction & Structural Drying: Deployment of industrial truck-mounted vacuum units, LGR desiccant dehumidifiers, high-velocity axial air movers, and moisture monitoring according to ANSI/IICRC S500 standards.
- State-Licensed Mold Remediation: Establishment of negative pressure HEPA containment barriers, structural antimicrobial decontamination, and post-remediation air clearance protocols under Florida DBPR regulations.
- Fire, Soot & Smoke Damage Mitigation: Structural board-up, hazardous soot filtration, thermal fogging, hydroxyl deodorization, and HVAC duct decontamination.
- Emergency Roof Tarping & Weather Defense: Rapid installation of heavy-duty, weather-resistant tarps and temporary structural seals to prevent secondary rain and wind intrusion.
- Biohazard, Sewage & Category 3 Loss Cleanup: Decontamination of black water, sewage backups, and biological contaminants complying with OSHA 29 CFR 1910.1030 bloodborne pathogen standards.
3. Property Access, Utility Requirements & Work Authorization
To execute time-sensitive stabilization and prevent catastrophic structural rot or toxic mold proliferation, the Customer grants PureClean and its licensed technicians:
- Unrestricted Continuous Access: Full physical access to the affected real property, building mechanicals, electrical panels, and common areas during the active mitigation and drying periods.
- Utility Supply: Uninterrupted access to on-site electrical power and water supplies necessary to operate industrial drying equipment, air scrubbers, and extraction pumps. If on-site power is unavailable, PureClean may deploy portable generators at prevailing line-item rental rates.
- Equipment Safety & Non-Interference: The Customer agrees not to turn off, unplug, relocate, or tamper with dehumidifiers, air movers, or HEPA containment barriers without explicit written instructions from the designated PureClean Project Manager. Moving or deactivating equipment impairs drying efficiency and voids moisture clearance guarantees.
4. Direct Insurance Claims, Billing & Financial Responsibility
PureClean works collaboratively with all major residential and commercial insurance carriers operating in Florida (including Citizens Property Insurance, State Farm, Allstate, Liberty Mutual, USAA, Travelers, and Chubb).
While PureClean coordinates direct carrier billing with $0 upfront stress for covered losses, the primary property owner or authorized insured party remains ultimately responsible for statutory policy deductibles, non-covered endorsement limits, or carrier claim denials.
Direct Pay & Assignment Directives: The Customer authorizes PureClean to submit detailed photographic evidence, FLIR thermal logs, psychrometric records, and Xactimate® invoices directly to the insurance carrier. The Customer irrevocably instructs the insurance carrier to name PureClean Restoration Service, Inc. as a direct payee on claim settlements pertaining to emergency mitigation services rendered.
Customer Deductible: In accordance with Florida insurance statutes, insurance deductibles cannot be unlawfully waived or credited. Deductibles are payable by the Customer upon initial billing or claim resolution.
5. Florida Statutory Compliance (DBPR, EPA & IICRC)
PureClean conducts all operational activities in strict adherence to federal, state, and industry regulatory frameworks:
- Florida DBPR Mold Statutes: Work is executed in compliance with Florida Statutes § 468.8411 - 468.8425. PureClean technicians hold active master licenses for Mold Assessment (MRSA) and Mold Remediation (MRSR).
- IICRC S500 & S520 Protocols: Water extraction, structural drying, and fungal containment adhere to the Institute of Inspection, Cleaning and Restoration Certification (IICRC) global standard reference guides.
- EPA Lead-Safe Certified: For structures constructed prior to 1978, containment and dust-suppression follow EPA RRP (Renovation, Repair, and Painting) rules (40 CFR Part 745).
- OSHA Worker Safety: All containment entry, personal protective equipment (PPE), and biohazard disposal meet OSHA 29 CFR standards.
6. Customer Responsibilities & High-Value Contents
Prior to the initiation of heavy structural extraction or demolition, the Customer is responsible for:
- Securing and removing all cash, precious jewelry, firearms, confidential financial documents, prescription medications, and irreplaceable personal heirlooms from the affected work zones.
- Notifying PureClean of any known pre-existing hazardous conditions, structural defects, hidden electrical wiring anomalies, or asbestos-containing building materials (ACBM).
- Keeping children, unauthorized occupants, and pets entirely outside of sealed HEPA negative air containment zones and drying areas until final clearance testing is achieved.
7. Work Completion & Moisture Clearance Protocols
Mitigation services are deemed complete when psychrometric moisture readings taken by PureClean technicians confirm that structural framing, drywall, subfloors, and ambient humidity have reached the established dry standard in accordance with IICRC S500 guidelines.
For microbial remediation projects, formal clearance is established via independent Post-Remediation Verification (PRV) and air cassette sampling analyzed by an AIHA-accredited laboratory. PureClean does not remove containment barriers until target clearance criteria are satisfied.
8. Right of Rescission & Cancellation Policy
Emergency Exemption: In situations where emergency mitigation services are immediately necessary for the preservation of residential or commercial real property from imminent secondary degradation (e.g., active flooding, black water sewage overflow, hurricane roof breaches), statutory rescission waiting periods may be waived under Florida law upon Customer's written or oral emergency directive.
Cancellation of Scheduled Services: For non-emergency planned assessments, the Customer may cancel prior to the dispatch of specialized equipment trailers without penalty. Once mobilization, equipment staging, or chemical application has commenced, the Customer shall be liable for all reasonable labor hours, fuel surcharges, equipment disinfection fees, and non-recoverable materials expended.
9. Warranties & Limitation of Liability
Limited Workmanship Warranty: PureClean warrants that all emergency mitigation, extraction, and drying services shall be executed with standard industry care conforming to prevailing IICRC professional guidelines.
Exclusion of Pre-Existing & Latent Defects: PureClean shall not be liable for pre-existing structural rot, hidden architectural flaws, pre-existing foundation cracks, non-disclosed asbestos or lead paint, biological contamination originating in untreated building zones, or secondary damages caused by the Customer turning off industrial drying equipment prematurely.
Consequential Damages Waiver: Under no circumstances shall PureClean Restoration Service, Inc., its directors, officers, technicians, or subcontractors be liable for indirect, incidental, special, consequential, or punitive damages (including loss of business profits, temporary relocation expenses, or loss of rental income) arising out of or related to the performance of services.
10. Governing Law, Florida Jurisdiction & Venue
These Terms of Service, any associated Work Authorization, Assignment of Benefits, and all disputes arising out of the contractual relationship between the parties shall be governed by, construed, and enforced in accordance with the substantive laws of the State of Florida, without regard to its conflict of law principles.
The parties irrevocably agree that the exclusive jurisdiction and venue for any legal action, claim, or proceeding arising under this agreement shall reside within the State or Federal courts located in Miami-Dade County, Florida. The prevailing party in any litigation shall be entitled to recover reasonable attorneys' fees and court costs.
